1. General Provisions

  1. The Website www.itprofessionals.com.pl operates based on the rules determined in these Regulations.
    2. The Regulations determine types and scope of services supplied electronically by the Website www.itprofessionals.com.pl, the rules regarding provision of such services, terms and conditions of entering into and terminating electronic services agreements, as well as complaint procedure.
    3. At the moment of undertaking activities aimed at using the Website’s Electronic Services, a customer is obliged to abide by the provisions of these Regulations.

2. Definitions

REGULATIONS – these Website regulations

WEBSITE – website of the Service Provider operating at  www.itprofessionals.com.pl

SERVICE PROVIDER

CUSTOMER –  (also referred to as the Candidate) an adult natural person who uses electronic services within the Website in order to apply to a chosen job offer, in particular who sends CV via electronic means in order to present it to the Service Provider and the Potential Employer

ELECTRONIC SERVICE – a service supplied electronically by the Service Provider for the benefit of the Customer via the Website based on these Regulations

AGREEMENT – an agreement entered into between the Candidate and the Controller in order for the Candidate to participate in a recruitment process and in particular in order to send and present his or her CV to the Service Provider and the Potential Employer (upon the Candidate’s consent)

APPLICATION FORM – a form available on the Website which makes it possible for the Customer to apply to a chosen job offer published on the Website by the Service Provider

POTENTIAL EMPLOYER – a company which may be interested in employing the Candidate for a given position and which the Service Provider cooperates with

PRIVACY POLICY – a document regulating security of privacy protection and personal data processing of the Website’s users. Privacy Policy constitutes attachment to these Regulations and is its integral part. It is available at the website: www.itprofessionals.com.pl/privacy.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the European Union L. No. 119, page 1)

3. Type and scope of Electronic Services

 

  1. The Service Provider makes it possible to use via the Website the Electronic Services such as:
    1. enabling the Customer to apply to a chosen job posts with the Potential Employer by filling in and sending the Application Form;
    2. sharing with the Customer contact data of the Service Provider such as address, phone numbers, e-mail addresses (they are not, however, called automatically).

2. Provision of Electronic Services for the benefit of the Customers occurs according to the terms and conditions stipulated in the Regulations.

    4. Rules of using the Website

    1. The Service Provider publishes Job Offers in “Job Offers” tab for the purposes of execution of recruitment projects conducted for the benefit of the Potential Employers.
      2. The Customer has the possibility to view the Job Offers and to apply to a chosen Job Offer using the Application Form.
      3. When applying to the chosen Job Offer, the Customer is asked to fill in the following data: name and surname, e-mail address and CV. Providing a phone number is optional.
      4. The Customer may send their CV via the Website in the form of an attachment in PDF or DOC/DOCX format.
      5. Having filled in the Application Form, the Candidate is asked to confirm that he or she has familiarized himself/herself with the Privacy Policy (containing disclosure requirements, GDPR Art. 13) and these Regulations by selecting relevant checkbox. Selecting the checkbox concerning familiarizing with Privacy Policy and the Regulations is obligatory in order for the application to be sent to the Service Provider.
      6. Additionally, the Application Form contains the checkboxes regarding the Customer’s will to:
      1. agree for the processing of his or her personal data by the Service Provider for the benefit of future recruitment processes,
      2. enable it for the Service Provider to process the data shared publicly by the Customer on LinkedIn.
      3. Such consent is voluntary.
      7. By clicking “Apply” button in the Application Form, the Candidate agrees (by his or her activities) to conduct recruitment and hand over the data to the Potential Employer.
      8. Personal data sent in the application documents within the scope of data of Article 22(1) of the Labor Code such as: name (names) and surname, date of birth, contact data, education, skills and qualifications is obligatory in order to participate in the recruitment process and the processing will occur based on Article 6(1)(b) of the GDPR. In the event when broader scope of data is sent, such data will be processed based on the consent, i.e. Article 6(1)(a) of the GDPR as a voluntary activity after familiarizing with the content of disclosure requirements.
      9. The Customer is obliged to include in his or her application documents, i.e. CV, only such personal data and other information which is necessary to perform particular type of work or at a particular position. Otherwise, the Service Provider reserves the possibility not to review the recruitment application.
      10. Electronic Service Agreement is entered into at the moment when the Customer clicks: “Apply” in a correctly filled in Application Form.
      11. The Service Agreement may be terminated by the Customer at any time without stating a reason.
      12. The Service Provider reserves the right to contact only the Candidates selected by them.

    5. Rules of using the Website by the Customer

    1. The Customer does not cover any additional fees connected with execution of the Electronic Services listed in these Regulations.
    2. By applying to a job offer, the Customer represents that:
      1. the data provided by him or her are complete, truthful and factually correct and he or she does not infringe any rights of third parties;
      2. he or she is of legal age and eligible to enter into the Services Agreement and agrees for the processing of his or her personal data in order to provide the Services by the Service Provider;
      3. He or she agrees for forwarding his or her application to the Potential Employer having obtained the name of such Employer while retaining the right to oppose. 
    3. The Customer is obliged to use the Website in the manner compliant with law and good manners, taking into account respect for personal property and intellectual property rights of third parties.
    4. It is not allowed to send via the Website’s Application Form the content which constitutes threat, slander, vulgarism, as well as which may breach any rights of third parties. It is not allowed to send via the Application Form the files which contain viruses or other harmful elements which may influence the functioning of the Website, as well as spam content.
    5. The Customer represents that he or she will keep secret any confidential information handed over to him or her by the Service Provider during the recruitment process.
    6. In order to be able to use the Website shared with the Service Provider, the Customer needs to meet the following technical requirements:
      1. a computer with Internet access,
      2. access to e-mail,
      3. web browser,
      4. Cookies and JavaScript enabled in the web browser,
      5. provision of services occurs using HTTPS protocol.

    6. Obligations and Role of the Service Provider

    1. The Service Provider represents that they will make an effort in order for the Website to operate without any disturbance but they also represent that they are not liable for temporary unavailability of the Website or its improper functioning connected with maintenance, reconstruction, technical problems or other reasons.
    2. The Service Provider is not liable for possible loss or damage of suffered by the Customer relying on the information contained on the Website or using that information.
    3. The Service Provider does not guarantee that the Potential Employer will be interested in employing a given Customer. The Service Provider does not also guarantee any results of further recruitment process conducted between the Potential Employer and the Customer. The Service Provider is also not liable if the Potential Employer, despite the arrangements and promises made to the Customer, does not employ him or her or employed him or her based on the terms and conditions other than those agreed between them.
    4. Before the Service Provider hands over the Customer’s application documents to the Potential Employer, they will contact the Customer to determine whether the Customer is interested in handing over such documents to that particular Potential Employer, and therefore participation in the recruitment process.
    5. The Customer has the right to file a complaint about performance of the Electronic Service described in these Regulations. The complaint should be sent to the e-mail address of the Service Provider (contact@itprofessionals.com.pl). The Service Provider will inform the Customer about their decision as regards reviewing the complaint via e-mail.
    6. A correctly submitted complaint referred to in paragraph 5 above should contain at least the following data:
      1. designation of the Service Provider;
      2. description of the problem which is the basis for filing the complaint.
    7. The Service Provider will review the complaint within 14 days from the date of its receipt by the Service Provider.
    8. The Service Provider reserves the right to introduce at any time:
      1. changes to the data being part of the Website;
      2. changes of the Website’s technical parameters;
      3. temporary or permanent restriction the Website’s availability;
      4. complete withdrawal of the Website.

     

    7. Intellectual Property

    1. The entire content placed on the Website www.itprofessionals.com.pl benefits from copyright protection and is the ownership of the Service Provider. The Customer is fully liable for the damage caused to the Service Provider which is the consequence of using any content of the Website www.itprofessionals.com.pl without the consent of the Service Provider.
      2. Any use by anyone, without the express written consent of the Service Provider, of any element making up the content of the Website www.itprofessionals.com.pl constitutes the breach of copyright the Service Provider is entitled to and results in civil law and penal liability.

     

    8. Final Provisions

    1. These Regulations enter into force of 1 May 2021.
      2. The Service Provider reserves the right to change the services provided as well as the Regulations concerning the services provided. In the case of change of any of the Services provided, the Service Provider will notify the User about the change by placing by the Service Provider on the main site of the Website the information on the change of the Regulations, which will contain the list of changes in the Regulations and such information will be kept on the main site of the Website for the period of at least 14 consecutive calendar days. The Users who used the Services of the Website, i.e. applied to a job offer using the Application Form, will be additionally informed by the Service Provider by sending to the e-mail address provided by him or her in the Application Form the information containing the list of changes in the Regulations. Informing about the changes in the Regulations will occur not later than 14 calendar days before introduction of the changed Regulations. If the User having the User Account does not accept new content of the Regulations, he or she is obliged to inform the Service Provider about that within 14 days from the date of notification about the change in the Regulations.
      3. The Regulations and the Service Agreements are subject to Polish law.
      4. Provisions of the Act on Providing Services by Electronic Means, the Act on Personal Data Protection, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Civil Code and other provisions of the law in force apply in the cases not regulated by these Regulations.
